Active duty men and women who suffer injury
or death due to the negligence of other members of the armed forces are barred
from suit under the case of Feres v. United States, 340 United States 135
(1958). This United States Supreme Court case provides immunity to the
malpracticing military doctor (for example), but may allow the injured patient
to file a claim with the federal government to compensate for their injuries.
